Terms of Service
Last updated: 29 October 2026
1. Who we are and when these Terms apply
Media Moonlight is operated by XYZ Projects KLG, c/o Nils Meyer, Goldschrütifeld 14b, 6017 Ruswil, Switzerland, UID CHE-187.378.582 ("Media Moonlight", "we", "us"). Contact: info@mediamoonlight.com.
These Terms govern access to mediamoonlight.com and to our AI tools, accounts, subscriptions, token purchases and the My Creations gallery (the "Service"). They apply to individual consumers and business customers. A business user entering into a contract for an organisation must be authorised to do so.
Before you place a paid order, the checkout shows the selected offer, its price, whether it renews and how to cancel it, together with these Terms. The accepted offer and the order confirmation specify what you purchased. Mandatory legal rights take priority over these Terms.
Our Privacy Policy explains how we process personal data. Accepting these Terms is not consent to marketing or to any other processing that legally requires separate consent.
2. Eligibility, accounts and guest use
You must be at least 16 years old to use the Service, with or without an account. If a particular tool or applicable law requires a higher age, that higher age applies to that tool or use.
If you have not reached the age of legal majority where you live, your parent or legal guardian must authorise your use and any paid purchases to the extent required by applicable law.
Provide accurate registration and billing information, protect your login details and notify us promptly if you suspect unauthorised access. You are responsible for activity you authorise through your account, subject to applicable law. Do not use someone else's account without permission.
Guest use
Some tools can be used without an account ("guest"). Your free tokens and creations as a guest are linked to the browser you use, not to you as a person. If you sign up or log in within the same browser while your guest creations are still stored (Section 11), they move into that account, together with any unexpired free tokens (Section 6). Guest creations cannot be moved from another browser or device, and they are lost if you clear your browser's site data. Download anything you want to keep.
One free allowance per person
Do not create several accounts, reset or switch browsers, change networks or use similar means to obtain free tokens or sign-up bonuses repeatedly.
3. AI tools and results
The Service offers AI-powered generation and editing tools: image generation, video generation (from text or from a start image), upscaling, logo creation as SVG, restoration and colourisation of old photos, background removal and raster-to-SVG vectorisation. Each tool page shows the selected AI model, the available settings and the token price before you click Generate.
The Vectorize tool converts uploaded raster images, including logos, into SVG vector files using Recraft Vectorize. You must have the rights needed to upload, convert and use the source material. Conversion does not clear third-party rights or make an existing logo yours. Review the converted paths, text and details before use; exact reproduction is not guaranteed.
AI output is probabilistic. It may contain inaccuracies, visual defects, unexpected details or content that does not match your expectations. A particular style, exact prompt interpretation, unique result or commercially successful result is not guaranteed unless expressly agreed.
You are responsible for choosing suitable prompts and inputs and reviewing outputs before using or publishing them. Do not treat outputs as verified facts or as professional legal, medical, financial or other regulated advice.
Subject to mandatory rights relating to faulty or non-conforming services, a successfully completed generation does not qualify for an automatic token refund solely because you dislike the result or your prompt did not achieve the intended creative effect. This does not excuse us from providing the functionality and quality we expressly promised.
Several requests in a row
You can send a new request without waiting for the previous one to finish. A limited number of requests run at the same time; further requests wait in a queue on the tool page, and the number of open requests is limited. While a request is waiting, no tokens have been charged for it and you can remove it. Once a request has started, it has been sent to the AI provider and can no longer be stopped; its tokens are charged (and returned automatically if it fails, see Section 7). A started request continues even if you leave the page, and its result appears in My Creations when it is ready.
Refused requests
We automatically check prompts and refuse requests that sexualise minors. AI models also apply their own safety filters, which differ between models. A request we refuse before it starts costs nothing. A request the AI model refuses or fails to complete is refunded automatically.
4. Orders, prices and payments
Plans and token packs are priced in US dollars (USD). The total amount, applicable taxes, the billing interval and whether an offer renews are shown at checkout before you place the order. We do not add Swiss VAT unless legally required. Taxes that apply to customers in other jurisdictions remain unaffected.
The use of a tool is priced in tokens. The token price for the selected tool, model and settings is shown before you click Generate, and exactly that price is charged when the request starts. Token prices can change for future requests; a change does not affect requests already started.
Payments are made through the checkout of our website platform Wix and processed by Stripe, with the payment methods shown at checkout. Your bank or card issuer may apply currency-conversion or other charges outside our control. Payment details are handled by Stripe as explained in our Privacy Policy; we do not receive your full card details.
A paid contract is formed when we accept your order and issue the order confirmation. If a payment cannot be completed or an order cannot be accepted, we will inform you and return any amount collected for an unaccepted order.
If a payment is refunded, reversed or charged back, we may remove the tokens credited for that payment to the extent they are still in your account. Mandatory rights remain unaffected.
5. Monthly subscriptions and multiple active plans
Subscriptions ("plans") renew automatically each month unless cancelled before the next renewal. The price, monthly token allowance, storage space, billing date and included features of each plan are stated in its offer and confirmation. A plan's tokens for a monthly period are added to your account when that period starts.
Buying another plan adds a separate subscription; it does not replace or cancel an existing subscription. For example, buying Large while Mini is active means that Mini and Large remain active, each with its own recurring charge, token allowance, renewal date and cancellation. Their storage spaces for pinned creations add up (Section 11).
Each subscription provides its stated token allowance for its own monthly period. Unused subscription tokens expire at the end of the period to which they relate and do not roll over. If subscriptions have different renewal dates, their token allowances reset on different dates.
There is no automatic upgrade, downgrade, trade-in or credit for an existing subscription when you buy another plan. You may cancel an existing subscription and separately purchase another one. The checkout shows the additional subscription and its charge before you confirm the purchase.
You can cancel any subscription at any time in your account under "My Subscriptions", or by sending an email to info@mediamoonlight.com with enough information to identify the subscription. Cancellation stops future renewals of that subscription and takes effect at the end of its current paid period. Included access continues until that period ends.
Cancelling one subscription does not cancel your other subscriptions. Unless a refund is legally required or approved under Section 7, cancellation does not itself create a right to a partial refund for the current paid period.
We will tell you about any price change for future subscription periods in advance and give you the opportunity to cancel before it takes effect. We will not increase the price of a subscription period you have already paid for.
6. Tokens, top-ups and free allowances
Tokens are internal credits for eligible actions within the Service. They are not legal tender, an investment or a means of payment outside the Service. Except where the law requires otherwise, they cannot be transferred, sold or redeemed for cash.
Free tokens
Guests and account holders can receive a number of free tokens for a period of days. The current amount and period are shown on the website; we may change them for future periods. Your period starts with your first request. Once it has ended, your free tokens are set back to the current amount with your next request; unused free tokens do not carry over. Free tokens can be used only with tools that accept them; some tools require an account or tokens from a plan or token pack.
To keep the free offer available, we limit how many free allowances can be started from one network per week, may ask you to complete a CAPTCHA, and may limit the total free use per day. If the day's free budget is used up, your free tokens stay available for later, and a request can run on plan or top-up tokens instead.
Sign-up bonus
A new account can receive a one-time bonus of tokens. The bonus is granted once per account, per email address (variants of the same address count as one) and per browser. Addresses from disposable-email services do not qualify. Bonus tokens are added to your top-up balance and do not expire. The current amount is shown on the website; we may change it for future sign-ups.
Subscription tokens
Subscription tokens are allocated and expire as described in Section 5.
Top-up tokens (Token Packs)
Top-up tokens (Token Packs) are bought with a one-time payment. They do not have a scheduled expiry date and are not reset with monthly allowances. They remain subject to lawful refunds, account closure and termination of the Service under these Terms; "no expiry" does not mean that we may take away a paid balance at will. A token pack is not a subscription, cannot be cancelled once the tokens have been credited (subject to Section 8) and does not include storage benefits.
Order of use
Each request is paid in this order:
-
Free tokens.
-
Subscription tokens, starting with the plan that renews soonest.
-
Top-up tokens, including the sign-up bonus and token packs.
The tokens in the first available balance are always used first. If they do not cover the price, the rest comes from the next balance, so one request can be paid from several balances. Only balances that may be used for the selected tool count. If the day's free budget is used up (see above), the request is paid from subscription and top-up tokens and your free tokens wait.
We may change future free-token offers. This does not change the expiry rules of purchased top-up tokens.
7. Technical failures and refund requests
If a request fails because of a technical error, or the AI model refuses it, the tokens charged for it are returned automatically to the balances they came from. If this does not happen, contact info@mediamoonlight.com with the relevant details so we can correct it. A token reversal is distinct from a refund of a payment.
Requests for monetary refunds are reviewed by support based on the circumstances, the purchased service and applicable law. Contact info@mediamoonlight.com and identify the relevant purchase and the reason for the request. Any voluntary refund is separate from legal entitlements.
Nothing in these Terms removes statutory withdrawal rights, remedies for non-conforming digital services, rights relating to unauthorised payments or other mandatory consumer protections. We do not require you to accept a token credit instead of a monetary remedy where the law entitles you to the latter.
8. Consumer withdrawal rights
If mandatory law gives you a cooling-off or withdrawal right, you may exercise it in accordance with that law. In particular, distance contracts with consumers in the EU/EEA generally carry a 14-day withdrawal period from the conclusion of the contract, subject to the applicable rules and exceptions.
To withdraw, send a clear statement identifying the contract to info@mediamoonlight.com or to our postal address in Section 1. You may use the model form below, but it is not compulsory. It is sufficient to send your notice before the withdrawal period ends.
If you validly withdraw, we reimburse your payments, generally within 14 days of receiving your notice, using the original payment method unless another method is expressly agreed without additional cost to you.
At checkout, you are asked to confirm by ticking a box that you expressly agree that your plan starts, or your token pack's tokens are credited, immediately after payment and before the 14-day withdrawal period ends, and that you are aware that you lose your right of withdrawal once the tokens have been credited. Where the legal requirements for such a request and acknowledgement are not met, your withdrawal right is unaffected. If you validly withdraw from a service you asked to start early, an amount proportionate to what was already provided may be payable where the law allows it.

9. Your inputs, outputs and intellectual property
You retain any rights you hold in prompts, uploads and other inputs. You must have the rights and permissions needed to upload and process them, including relevant copyright, trademark, privacy and image rights. If an uploaded picture shows a person, you confirm that you have that person's consent, and for a minor the consent of a parent or guardian, and that the picture shows nothing unlawful. We do not review uploaded pictures before they are processed; you are responsible for them.
You grant us a non-exclusive licence to host, copy, transmit and process your inputs and outputs only as reasonably necessary to deliver, secure and support the Service and to fulfil legal obligations. This includes processing by the providers named in our Privacy Policy, and keeping your prompt, settings and any reference or start image with your creation so that you can view and recreate it (Section 11). It is not a licence to publish your files, advertise with them or train our own AI models on them.
We do not claim ownership of rights you hold in your generated outputs. Whether AI-generated material is protected by copyright or other rights depends on applicable law. Outputs may be similar to other users' results and are not guaranteed to be exclusive, registrable as a trademark or free of third-party rights.
You may use outputs commercially to the extent the licence of the model used, these Terms and applicable law allow. The model-specific conditions below apply in addition. A model's licence does not by itself guarantee that every possible output is lawful for every commercial purpose.
Models offered and model-specific conditions

Model and publisher names identify the technology; they do not imply an endorsement or a direct contract with each publisher. Using a model through the Service does not give you the right to download or redistribute model weights, resell API access or operate the Service as an API proxy.
Recraft (Logo and Vectorize)
You must not use the generated assets to train AI models or systems. Preserve provenance markings and obtain the necessary permissions for references to identifiable people or third-party brands. See the Recraft Developer Terms. Recraft Vectorize permits commercial use of its results, subject to the rights in your source material.
FLUX (FLUX 3 and Restore)
The FLUX Usage Policy applies. It prohibits, among other things, electoral persuasion or deception, military, surveillance and law-enforcement uses, biometric or sensitive-trait inference, harmful automated decisions and the removal of provenance signals. Realistic depictions of real people in abusive contexts require their verified, informed consent.
Runway (Gen-4.5)
The Runway Usage Policy applies. Do not use outputs to develop products or services that compete with Runway where Runway's terms prohibit this.
Commercial permission does not guarantee copyright protection, trademark registration, exclusivity or clearance of third-party rights. Logo and vector outputs need the same rights review as other outputs.
Our website design, software, branding and other materials remain owned by us or our licensors. You receive permission to use the Service as offered, not ownership of those materials.
10. Private gallery, processing and training
Your gallery (My Creations) is private. We do not publish your inputs or results, share them with other users or use them in our marketing without your separate permission. The AI providers that run the models process your requests to produce the results, and their staff may have access where their safety, support or legal duties require it.
Media Moonlight does not use your inputs or outputs to train AI models. The providers behind the models work under their own terms. The general terms of Black Forest Labs (FLUX) and Runway allow them to use inputs and outputs to improve their models; it is not confirmed whether this also applies to requests sent through Replicate. Recraft does not train its models on results created through its API. Our Privacy Policy explains this in more detail. Do not submit personal or confidential content you do not want a provider to process.
Replicate's temporary processing is separate from the storage of your creations with us (Section 11). We do not offer end-to-end encryption.
11. Storage, pinning and deletion
How long creations are kept
My Creations keeps your results automatically for a limited time:
-
Guest (no account): 7 days
-
Account without a running plan: 14 days
-
Account with at least one running plan: 90 days
The period is set when the creation is made and is shown with each creation ("kept until …"). Starting or ending a plan does not change the period of creations that already exist. A creation is stored together with its prompt, its settings and, if you used one in the Image or Video generator, its reference or start image, so that you can view and recreate it. When a creation expires or you delete it, its file, prompt and reference image are deleted. A record of the request without the prompt or any file remains part of our token records, as explained in the Privacy Policy.
Pinning
Account holders can pin creations. A pinned creation is kept until you unpin or delete it, or delete your account. Pinned creations, including their stored reference images, count toward your pin space. Accounts without a plan have a basic pin space; each running plan adds the storage stated in its plan description, and several plans add up. Your current space and use are shown in My Creations. If your pin space becomes smaller, for example because a plan ends, creations that are already pinned stay pinned, but you cannot pin more until your use is below your space. When you unpin a creation, it is kept for the period that applies to your account at that time, counted from unpinning. We may change the pinning rules for the future with reasonable advance notice; we will not delete pinned creations without such notice.
Pinned storage is not an archiving service. Download and keep your own copies of files you want to retain. This does not limit our responsibility for the storage we have promised.
Deleting creations
You can delete individual creations in My Creations at any time. The file, its prompt and its reference image are deleted at once.
Deleting your account
To delete your account, send a request to info@mediamoonlight.com from the email address of your account. Before we delete it, we tell you that your token balances and files will be lost, so that you can download what you want to keep. We then end your running plans so that no further charges are made, delete your account and your content, and confirm the deletion to you, at the latest within one month of your request.
When your account is deleted, all remaining token balances, including purchased top-up tokens, are forfeited, and all your creations, including pinned creations, prompts and reference images, are deleted as described in our Privacy Policy. Account deletion does not by itself entitle you to a refund of unused tokens or subscription charges. This does not exclude mandatory withdrawal rights, refund rights or other claims that cannot lawfully be waived. Records we must keep for accounting and legal purposes remain, without your content, as explained in the Privacy Policy.
12. Prohibited use
You must not use the Service to:
-
Upload, generate or distribute unlawful content or content that infringes copyright, trademarks, privacy, image rights or other third-party rights.
-
Create, obtain or distribute child sexual abuse or exploitation material, or sexualised depictions of minors, including synthetic depictions.
-
Create non-consensual intimate imagery, exploit people sexually, or use personal images in ways that violate their rights.
-
Commit fraud, harmful impersonation, harassment, unlawful discrimination or threats, or facilitate other criminal activity.
-
Upload malware, compromise systems, bypass safeguards or interfere with the Service or its users.
-
Circumvent age restrictions, account suspensions, payment requirements, token limits, free-token limits, our prompt checks or provider safety restrictions.
-
Send automated or scripted requests, or use several browser tabs or tools to get around the limits on open requests.
The model-specific conditions in Section 9 also apply. We may refuse or stop prohibited processing and take proportionate steps to investigate and prevent abuse. Where legally required, we may preserve relevant information or respond to valid requests from competent authorities.
Report rights violations or harmful content to info@mediamoonlight.com with enough information to identify the issue.
13. Availability, changes and account restrictions
We aim to provide reliable access, but maintenance, outages, capacity limits and third-party failures may affect availability. A model or tool may be unavailable at times or replaced; the tool page shows what is currently offered. No specific uptime commitment applies unless expressly included in your offer. Mandatory remedies for service failures remain available.
We may make reasonable technical or security changes and update available tools. We will tell you in advance about material changes to paid features, these Terms or renewal conditions where the law requires it, and obtain your agreement where the law requires it. Continued use does not waive statutory rights or count as acceptance of changes that legally require explicit consent.
We may temporarily restrict access where reasonably necessary to address a security risk, a suspected material breach, unlawful activity or a failed payment. Where appropriate, we will explain the reason and give you an opportunity to resolve it, unless doing so would be unlawful or compromise security. You may contact support to contest an account decision.
Restrictions, termination or discontinuation do not automatically eliminate claims to refunds or other remedies. If we discontinue the Service, we will give reasonable advance notice where practicable, give you a reasonable opportunity to download stored files, and deal with paid subscriptions and unused purchased tokens in accordance with applicable law.
14. Responsibility and liability
You are responsible for the legality of your inputs and intended uses of outputs and for reviewing outputs before relying on or publishing them. This does not make you responsible for faults attributable to us or remove rights that cannot legally be excluded.
We do not guarantee that every AI result will meet a subjective creative preference or that an output can be protected or used without further clearance. Apart from these inherent limitations, we remain responsible for providing the Service as described and as required by applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, gross negligence, or death or personal injury where applicable. Mandatory consumer guarantees and remedies remain unaffected.
For business customers, to the extent permitted by applicable law, we are not liable for indirect or consequential business losses, such as lost profits or lost business opportunities, except where liability cannot lawfully be excluded. This exclusion does not apply to consumers.
15. Governing law, disputes and contact
These Terms are governed by Swiss law. For consumers, this choice does not deprive you of mandatory protections under the law that would apply without that choice, including mandatory protections in your country of habitual residence.
Consumers retain all mandatory rights concerning where they may bring proceedings or be sued. For business customers, the competent courts at our registered seat in Switzerland have jurisdiction, subject to any mandatory jurisdiction rules.
Contact info@mediamoonlight.com about subscriptions, refunds, account issues or legal questions. We encourage you to contact us to resolve concerns, but doing so is not a condition for exercising statutory remedies or meeting a legal deadline.
If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. An invalid provision is not automatically replaced with a broader restriction of your rights.
